Optus and Boost Mobile have settled a trademark case revolving around Optus’ use of the term ‘Mobile Boost’ in a recent promotion.
In March, Optus launched a new ‘Mobile Boost’ feature that allowed its customers to pay an extra $2 for priority access to its network.
Boost Mobile quickly took legal action, and was granted an injunction that ordered Optus to stop using the phrase ‘Mobile Boost’ and other related terms.
Now the matter has been settled. The following joint statement was issued by the two telcos.
“Boost Tel Pty Limited and Singtel Optus Pty Limited have resolved their dispute concerning Boost Tel’s BOOST trade marks,” the statement reads.
“Boost Tel had alleged that the launch of new tools by Optus under the names ‘Optus Internet Boost’ and ‘Optus Mobile Boost’ was an infringement of its trade mark rights. The matter was due to be heard in the Federal Court on 20 June 2023.
“Optus denies it engaged in any trade mark infringement but for commercial reasons it has decided to relaunch these tools under different names. The terms of settlement are confidential.”
