Fujifilm Aus COO David Marshall Sues For ‘Ageism’, Seeking $1m

With tenure expanding eighteen years, Fujifilm Australia’s COO, David Marshall, is suing the organisation’s Chairman and Chief Executive for ageism, seeking up to $1 million in compensation, alleging they terminated his employment for “being too old”.

Last week, Mr Marshall launched legal proceedings in the Federal Court against company CEO Takeshi Yanese and Chairman Nobuhiko Koshimizu.

Reports state Mr Marshall was ‘mysteriously ousted’ from Fujifilm in July.

Mr Marshall’s statement of claim states that since May of this year, Fujifilm actively excluded him from high-level client and executive meetings. In addition, he states they disconnected his email and moved him to smaller offices.

Mr Marshall also affirms that Chairman Koshimizu and other Fujifilm executives repeatedly made discriminatory remarks surrounding his age of 59.

Marshall alleges in 2015 at a Melbourne restaurant, Fujifilm CEO Kevin Masud stood up and pointed at him, laughing whilst remarking, “Dave is too old” in front of senior clients.

The allegations go on to state, in 2017 Mr Koshimizu told Marshall that Fujifilm “wants you to find the next Mr Marshall”, directly stating it was seeking a  “young, strong” team.

Koshimizu is also alleged to have said, “Dave, you and I are old too. We need a younger person to make [photo imaging] strong as a general manager”.

Ultimately, Mr Marshall states that Chairman Nobuhiko Koshimizu’s behaviour, often done in the presence of CEO Takeshi Yanese, culminated in the dismissal of Mr Marshall, and is deemed unlawful adverse action.

David Marshall, Fujifilm’s Chief Operating Officer is set to depart in early October, and as part of his legal proceedings is seeking up to $1 million in compensation for loss of income and benefits.

Marshall’s 2013 contract is reported to encompass the following remuneration package; $430,000 in salary per year, 14 per cent superannuation, a 10 per cent bonus, company vehicle, golf membership, private health insurance, plus payment of his home phone, internet and road tolls.

Mr Marshall is also seeking $100,000 in damages for “distress and suffering”, in addition to any civil penalties the court is imposing on Fujifilm and its Chief Executive Officer and Chairman.
