Microsoft Wins Xbox 360 Round

The US Supreme Court has ruled in favour of Microsoft in the software giant’s bid to fend off class action claims by Xbox 360 owners.

The Xbox claimants had told the court they believed the videogame console gouges discs due to a design defect.

Microsoft, which has sold tens of millions of Xbox 360s, said a class action was improper because only 0.4 percent of console owners have reported disc scratches – and it claims misuse was the cause.

In an 8-0 ruling, the court overturned a 2015 decision by lower court that had allowed console owners to appeal the dismissal of their class action lawsuit in 2012.

In the previous court decision, console owners were allowed to voluntarily dismiss their lawsuit so they could immediately appeal the denial of a class action.

The Supreme Court ruled this is not permitted and plaintiffs must litigate their claims individually and get a final judgment before they can appeal.
